Land Disturbance & Site Development Permits

The city follows state and federal mandates in regulating construction sites to ensure all sediment remains onsite. The Storm water Engineering Division is currently implementing a comprehensive land disturbance permit program, including the revision of erosion and sediment control Best Management Practices standards and requirements. Also below is a link to the State's construction permitting program.

Generally, a LDP permit (Land Disturbance permit) is required for all sites disturbing one acre or more, or sites that disturb less than one acre when part of a larger common plan of development or sale that will disturb a cumulative total of one or more acres over the life of the project. However, all land disturbers are required to comply with the City Code regardless of the size of the land disturbance. The owner is ultimately responsible for the compliance of their site.

Contact the City's Engineering Department for assistance with this process. After the application for permit, and prior to issuance of the LDP, contact the Engineering Department to schedule a preconstruction meeting:

Necessary Information


Before scheduling a preconstruction meeting, the following is needed:
  • Evidence of Planning Commission approval of development plans
  • Site development plans and drainage calculations approved by engineering Department
  • SWPPP - Contact Gallatin Department of Engineering for a preconstruction checklist, which includes the following:
    • Narrative
    • Grading Plans (initial and final)
    • EPSC Plans and BMP details
  • Drainage calculations
  • Copy of TDEC Notice of Coverage under the TNCGP
  • Land Disturbance Permit application and approval
  • Erosion Prevention and Sediment Control Plan
  • Approved permits from all Local, State, and Federal Regulartory agencies where applicable. 
  • Submittal of any required Letter of Credit or surety bond as required by City Departmental offices.

Timeline


City staff need the above materials at least 1 week (5 working days) prior to the desired meeting date. In addition to the general contractor, the EPSC specialist will need to be present at the preconstruction meeting.
